Terms & Conditions

By creating an account or using EcomTracker, you agree to these terms. They form a binding agreement between you and Smartx Innovations, and should be read alongside our Privacy Policy. If you don't agree, don't use the service.

EcomTracker is a business tool. You must be at least 18 and able to enter a binding contract under Indian law. If you accept on behalf of a company, you confirm you have authority to bind it.

Provide accurate details and keep your password confidential. You are responsible for everything that happens under your account, including activity by team members you invite.

An account is for one business. You may add team members within your plan's limits, but may not share a single login across people or businesses. Tell us at contact@ecomtracker.in immediately if you suspect unauthorised access.

Paid plans are billed in advance at the price shown on our pricing page and renew automatically until cancelled. Prices are in Indian Rupees; GST applies in addition.

You can cancel at any time from your settings — no notice period, no cancellation fee. Your plan stays active until the end of the period you've paid for. Fees already paid are non-refundable for partial periods except where the law requires otherwise.

If a renewal payment fails we'll retry and notify you, and may downgrade or suspend access until it's settled. Your data isn't deleted during that time. We may change plan pricing with reasonable notice by email, and you may cancel before it takes effect.

You agree not to:

• ✕ Resell, sublicense or white-label the service or its output as your own product
• ✕ Share credentials outside your business, or serve unrelated businesses from one account
• ✕ Attempt to access another customer's account or data
• ✕ Circumvent plan limits, rate limits or access controls
• ✕ Interfere with, probe or attempt to breach the platform's security
• ✕ Use the service unlawfully, or in breach of a marketplace's own terms

EcomTracker records what is publicly displayed on marketplace listing pages at the time of each check. Listings change constantly, pages can be temporarily unavailable, and marketplaces show different prices to different shoppers.

EcomTracker is independent. We are not affiliated with, endorsed by or partnered with Amazon, Flipkart or any other marketplace, and all marketplace names and logos remain their owners' property.

Your relationship with any marketplace is governed by that marketplace's own terms, and complying with them remains your responsibility. If a marketplace changes its platform in a way that affects our ability to read listings, we'll adapt where we reasonably can, but cannot guarantee continued coverage.

The EcomTracker platform, software, interface and branding belong to us. These terms grant a limited, non-exclusive, non-transferable right to use the service for your own business during your subscription — nothing more.

You may not copy, modify, reverse-engineer or create derivative works from the service, or use our name or logo without written permission, except to state factually that you use EcomTracker. If you send us feature suggestions, we may use them freely.

You own your data — your product list, competitor selections, settings and accumulated price history. You grant us only the licence needed to host and process it in order to run the service for you.

We do not pool, aggregate, resell or publish your data, and never use one customer's catalogue to inform another's account. You can export it as CSV at any time, and should do so before closing your account, since deletion isn't reversible. Full detail is in our Privacy Policy.

We aim to keep EcomTracker available continuously, but the service carries no guaranteed uptime unless a separate agreement has been signed with you. Occasional missed or delayed checks — from marketplace changes, network faults or maintenance — are not a breach of these terms.

Support is provided at your plan's level during Indian business hours, and covers use of the service rather than advice on your pricing strategy. We may add, change or remove features, giving reasonable notice where a change materially reduces functionality you rely on.

You may close your account at any time from your settings. We may suspend or terminate it if you breach these terms, if payment stays unpaid after notice, if your use threatens the platform's security, or if the law requires it — warning you first where circumstances allow.

After termination, access ends and your data is deleted in line with our Privacy Policy. The sections on intellectual property, liability and governing law survive.

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied.

You agree to indemnify us against claims, damages and reasonable costs arising from your misuse of the service, your breach of these terms or of a marketplace's terms, or your infringement of a third party's rights.

We may revise these terms; the version published on this page is always current. For material changes we'll notify account holders by email before they take effect. Continuing to use EcomTracker afterwards constitutes acceptance, and you may cancel if you don't accept.

These terms are governed by the laws of India, and the courts at Nashik, Maharashtra have exclusive jurisdiction. Before starting proceedings, both parties agree to attempt resolution in good faith, allowing thirty days for a response.

If any provision is found unenforceable, the rest continues in force. These terms, together with the Privacy Policy and the plan details shown at purchase, form the entire agreement between us.
